What does it consist of?

Thanks to this law, over-indebted people will be able to reach an agreement with their creditors. In the event that this agreement is not reached, the total cancellation of the debts may be requested in court, after the transfer of goods and assets that are not essential for the development of their professional activity.

How do we process it?

In the first place, an out-of-court attempt should be made to hold a meeting with the creditors, in order to renegotiate the conditions of the debt. This agreement will be supervised by a bankruptcy mediator designated by the commercial registrar or by the notary, as the case may be.
In the event that no agreement is reached, the phase of the consecutive bankruptcy will begin, during which the judge may exonerate the debtor from the entire debt.
Before starting the procedure, our lawyers will analyze your specific case, giving you a professional commission sheet that will clearly explain the economic conditions and costs of the same.

Who can benefit from this law?

The Second Chance Law is aimed mainly at self-employed citizens and individuals who meet the following requirements:

  • Absence of sufficient patrimony to face the debts

  • The total amount of the debts must not exceed five million euro.

  • Good faith of the debtor (actual attempt to reach an agreement, not having committed certain crimes, etc.)
